EmployerSafety Terms of Service
Version 1.2, effective 2026-11-23. See also the Privacy Policy. Earlier version: version 1.1, in force until 2026-11-23.
The agreement between Globaltek LLC and every organization that uses EmployerSafety. Read sections 2, 12, 14 and 15 first: what the Service is not, and where responsibility sits.
These Terms of Service (the "Terms") are a binding agreement between Globaltek LLC, a Mississippi limited liability company, acting through its EmployerSafety division ("EmployerSafety," "we," "us"), and the organization that creates an account or otherwise uses the EmployerSafety service (the "Customer," "you"). By creating an account, clicking to accept, or using the Service, you accept these Terms on behalf of the organization you represent and confirm you have authority to do so. If you do not have that authority or do not agree, do not use the Service.
1. The Service
EmployerSafety is a web application that helps employers organize workplace safety records: employee training and certification records, written safety programs and documents, training sessions, jobs and job sites with their crews, documents, forms and acknowledgments, the import of existing records, reminders, verification pages, and an AI-assisted safety assistant (the "Service"). The Service is offered to businesses, not consumers, and is intended for use in the United States.
2. What the Service is not
2.1 Not legal advice. The Service, including every answer from the safety assistant, every document draft, every citation, every reminder and every status shown on a dashboard, is informational. It is not legal advice, it does not create an attorney-client relationship with anyone, and it is not a substitute for the judgment of your own safety professionals, a competent or qualified person as those terms are used in occupational safety regulations, or your own counsel.
2.2 No compliance determination. The Service never determines that your workplace, equipment, task, program, training or records comply with any law, regulation or standard, and nothing it shows should be read that way. A status of "current," "complete," or "covered" describes your records as you entered them, not your legal position.
2.3 Not a safety control. The Service does not inspect your workplace, does not monitor conditions, and cannot see hazards. Decisions about whether work is safe to perform are made by people on site.
2.4 Sources. The Service quotes and cites publicly available regulatory text, agency guidance and your own documents. Regulations change; cited text is as of the date shown. You are responsible for confirming current requirements with official sources for your jurisdiction.
2.5 AI-generated content. Parts of the Service are produced by artificial intelligence models. AI output can be incomplete, outdated or wrong even when it reads confidently. Every AI-produced answer and draft is labeled as such and must be reviewed by a qualified person before you rely on it or put it into use. When you upload files to import records or written programs, or to read a sign-in sheet, what the Service reads from each page is AI output too. It is shown to you as a proposal, and nothing becomes a record until a person with permission reviews and approves it. You, not EmployerSafety, decide what goes into your safety program. Each user acknowledges this section the first time they use the safety assistant.
3. Accounts and users
3.1 Your account. You are responsible for everything done under your organization's account, for keeping login credentials confidential, and for the people you invite. Notify us at once at service@globaltek.ai if you believe an account has been compromised.
3.2 Users you invite. You may invite employees and others to your organization at the roles the Service offers. Each user must be at least 18 years old. Employees under 18 may have training records kept in the Service by their employer but may not hold user accounts. You are responsible for telling your employees that their training, certification and related records are kept in the Service and for any notice or consent your own policies or applicable law require.
3.3 Accuracy. The Service works from what you enter. Reminders, statuses and assistant answers are only as good as the records behind them. You are responsible for the accuracy and completeness of your data.
3.4 Records made for others. When a user records that a person attended training or acknowledged a document, including an acknowledgment signed on paper, you are responsible for that record being true and for keeping any signed original your policies or the law require. A record marked as made in error stays in the history.
4. Your data
4.1 Ownership. You own the data you and your users put into the Service ("Customer Data"), including employee records, documents and questions asked of the assistant. We claim no ownership of it.
4.2 Our use of Customer Data. We use Customer Data only to provide, secure, support and improve the Service for you, to comply with law, and as described in the Privacy Policy. We do not sell Customer Data. We do not use Customer Data to train AI models. AI features send your inputs to a third-party model provider under the provider's published terms and the settings described in the Privacy Policy, section 5. We do not permit storage or training where the provider gives us that control.
4.3 Employee information. As between you and us, you are the controller of the personal information of your employees and other individuals in Customer Data, and we process it on your behalf and at your direction. You represent that you have the right to enter it and to have us process it as the Service does.
4.4 Return and deletion. During the subscription you can export your records from the Service. After termination we keep Customer Data for 30 days so you can export it, then delete it from active systems; backups age out within 35 days after that, subject to any retention the law requires. We keep the record of each acceptance of these Terms and of each notice we send under section 18.1 for as long as needed to show the agreement and the notice, including after the account is closed.
4.5 Aggregated data. We may use data about how the Service is used, in a form that does not identify you, your users or your employees, to operate and improve the Service.
5. Subscriptions, fees and billing
5.1 Plans. The Service is sold by subscription in tiers based on the number of workers whose records you keep, with optional add-on modules, at the prices shown at sign-up or on the pricing page. Prices exclude taxes.
5.2 Trial. A new organization gets a 30-day free trial, and no payment method is required to start it. When it ends, the organization becomes read-only until a subscription starts. Nothing is deleted.
5.3 Payment. Fees are billed in advance, monthly, to the payment method you provide, through our payment processor (Stripe). Subscriptions renew automatically at the then-current price until cancelled. If a payment fails we will retry and notify you; if it stays unpaid the organization becomes read-only.
5.4 Cancellation and refunds. You may cancel at any time from the billing page; the cancellation takes effect at the end of the current billing period, and you keep access until then. Fees already paid are not refundable except where the law requires.
5.5 Worker count. If your active worker count exceeds your tier, we will tell you and you have 14 days to move to the right tier. We do not charge overage without notice.
5.6 Price changes. We may change prices on at least 30 days' notice; the change applies at your next renewal after the notice.
6. Acceptable use
You will not: use the Service to violate law or the rights of others; enter data you have no right to enter; attempt to access another organization's data; probe, scan or test the Service's security without written permission; reverse engineer the Service; use automated means to extract data beyond the export features; use the assistant to generate content that is unlawful, harassing or intended to deceive; or resell the Service. We may suspend an account that threatens the Service or other customers, with notice where practical.
7. Intellectual property
The Service, its software, templates, prompts, interface and documentation are owned by Globaltek LLC and its licensors and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription in accordance with these Terms. Templates and AI drafts you complete for your own program become part of your Customer Data for your internal use. Regulatory text quoted in the Service is public information. Feedback you give us may be used without obligation.
8. Third-party services
The Service runs on infrastructure and services provided by others, including hosting, database, storage, email delivery, payment processing and AI model providers, listed in the Privacy Policy. We choose them with care. We rely on our providers' published terms and security commitments for confidentiality and security of the systems they run for us. We do not control them, and their availability affects ours.
9. Confidentiality
Each party will keep the other's non-public information confidential and use it only for the purposes of these Terms. Customer Data is your confidential information. This section does not restrict disclosures required by law, made with notice where lawful.
10. Security
We use commercially reasonable administrative, technical and physical safeguards, including encryption in transit and at rest, tenant isolation in the database, role-based access, and audit logging. No system is perfectly secure. You are responsible for the security of your own devices, networks and credentials.
11. Availability and support
We aim for the Service to be available at all times but do not guarantee uninterrupted or error-free operation. We may modify or discontinue features with reasonable notice where the change is material. Support is by email at service@globaltek.ai or through Help & feedback in the Service, during business hours in the Central time zone.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, GLOBALTEK LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND COMPLETENESS, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE, ANY ASSISTANT ANSWER, ANY DOCUMENT DRAFT, ANY CITATION OR ANY REMINDER IS ACCURATE, COMPLETE, CURRENT OR SUITABLE FOR YOUR WORKPLACE, OR THAT USE OF THE SERVICE WILL RESULT IN COMPLIANCE WITH ANY LAW, REGULATION OR STANDARD, OR WILL PREVENT ANY INJURY, ILLNESS, CITATION, PENALTY, INSPECTION FINDING OR LOSS.
13. Assumption of responsibility
You acknowledge that workplace safety, the content and adequacy of your safety program, the training and supervision of your employees, the condition of your equipment and work areas, and compliance with the laws that apply to you are your responsibility and remain so whether or not you use the Service. You will make your own safety and compliance decisions, using your own qualified people, and you will not rely on the Service as the sole basis for any such decision.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) GLOBALTEK LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR FOR ANY FINE, PENALTY, CITATION OR ABATEMENT COST ASSESSED BY ANY GOVERNMENT AGENCY, OR FOR ANY BODILY INJURY, ILLNESS, DEATH OR PROPERTY DAMAGE OCCURRING AT YOUR WORKPLACE, ARISING OUT OF OR RELATING TO THE SERVICE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE FEES YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS ARE A FUNDAMENTAL PART OF THE BARGAIN AND APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE STATES OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED.
15. Indemnification and hold harmless
You will defend, indemnify and hold harmless Globaltek LLC and its members, managers, employees, contractors and suppliers from and against any claim, demand, suit, proceeding, loss, liability, damage, fine, penalty, cost and expense (including reasonable attorneys' fees) arising out of or relating to: (a) your workplace, operations, equipment, employees, contractors or visitors, including any injury, illness, death or property damage; (b) any inspection, citation, penalty or enforcement action by any government agency; (c) your safety program, training, records or decisions, including decisions made with the help of the Service; (d) Customer Data, including any claim that it was collected, entered or processed without a required right, notice or consent; (e) your breach of these Terms or of law; or (f) your users' use of the Service. We will notify you promptly of any claim, let you control the defense with counsel reasonably acceptable to us, and cooperate at your expense; we may participate with our own counsel at our expense, and you will not settle any claim that admits fault on our behalf or imposes obligations on us without our written consent.
16. Term, suspension and termination
These Terms apply from the day you create an account until the account is closed. You may close the account at any time. We may suspend or terminate for material breach uncured 15 days after notice, for non-payment, for a threat to the Service or other customers, or if required by law. Sections 2, 4.4, 7, 9, 12 through 15, 17 and 18 survive termination.
17. Governing law and disputes
These Terms are governed by the laws of the State of Mississippi without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts sitting in Rankin County, Mississippi, and each party consents to that jurisdiction and venue. Any claim will be brought in the party's individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Each party waives any right to a jury trial to the extent permitted by law. Claims must be brought within one year after they arise.
18. General
18.1 Changes. We may update these Terms. We will post the new version with its effective date and, for material changes, notify account administrators by email at least 30 days before they take effect. Continued use after the effective date is acceptance. The Service also asks each user to accept a new version before continuing to use it after the effective date, and an administrator may accept it earlier on behalf of the organization.
18.2 Notices. Notices to us go to service@globaltek.ai or by mail to Globaltek LLC, EmployerSafety division, P.O. Box 1955, Brandon, MS 39042. Our office is at 1640 Lelia Drive, Suite 105, Jackson, MS 39216. Notices to you go to the administrator email on the account.
18.3 Assignment. You may not assign these Terms without our consent, except to a successor in a merger or sale of substantially all assets, with notice. We may assign to an affiliate or successor.
18.4 Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, except payment obligations.
18.5 Entire agreement; severability; waiver. These Terms and the Privacy Policy are the entire agreement about the Service and replace prior discussions. If any provision is unenforceable, the rest remain in effect and the provision is enforced to the greatest extent permitted. A failure to enforce is not a waiver.
18.6 Relationship. The parties are independent contractors. Nothing here creates a partnership, joint venture, employment or agency relationship, or makes EmployerSafety your safety officer, consultant or representative.
18.7 Government use. The Service is commercial software; if a government entity uses it, it does so under these Terms.
18.8 Contact. EmployerSafety, a division of Globaltek LLC. Office: 1640 Lelia Drive, Suite 105, Jackson, MS 39216. Mailing address: P.O. Box 1955, Brandon, MS 39042. Email service@globaltek.ai. Phone 463-777-2333.
19. Verification pages
If you turn on verification pages, EmployerSafety publishes, at your direction, a page for each code you create. The page shows the employee's name, job title and your company name, and the certifications and licenses you have entered, with dates, status and the last four characters of any number. It also shows certificate copies and required-training status if you turn those on. A page for a work location or a job also shows the site's name and address and lists the employees assigned there. Anyone who has the code or its link can view the page without signing in. You decide whether to use these pages, which codes to create, who receives them, and when to retire them. You are responsible for having the right to share this information. You are also responsible for giving your employees any notice, and getting any consent, that applicable law requires. EmployerSafety does not issue, verify or vouch for any training, license or certificate shown on a verification page.
